Alexander McFarlane, factor for Pearl Company of Glasgow,
alleged embezzlement while in employ of Pearl Company in Maryland,

We Colin Dunlop and Hugh Blackburn merchants in Glasgow considering
that John Pagan merchant in Glasgow for himself, and as lakeing
Burdine upon him, for the other surviving Partners of the Pearl's
Company in Glasgow on the one part, and Arthur Connell merchant
in Glasgow one of the Tutors Testamentars and factor appointed
by the deceast Thomas Wallace merchant in Glasgow late one of
the partners of the said Pearl's Company to Thomas Wallace his
only son and universall disponee a pupile in name and behalf of
the said pupile on the other part did by submission dated the
Eight day of Septembr las Submitt and referr all Clags Claims
pleas Contraversies and debateable matters what so ever being
and Standing betwixt the Said John Pagan and his Surviving partners
of the said Pearl's Concern and the said Thomas Wallace pupile
as in the right of fifth part or share of the said Companie Subject
which belonged to the said deceast Thomas Wallace his father.

And Whereas there appears to be a Claim of Three hundred pounds
Sterling against the Said John Pagan and his Partners in the said
Pearl's Concern for wages Said to be due to Alexander McFarlane
late factor to the Companie in Maryland, Which Claim (as it was
not properly ascertained to us, and as the Company aledged That
the said Alexander McFarlane when in their Employ embezzled their
Effects abroad to a far greater Extent than the foresaid Claim)
We did no bring into Computation at adjusting the value of the
Companies Subjects abroad as in Manner above Mentioned; Therefore
and In respect that hitherto there has been no Settlement of accounts
betwixt the Said Pearl's Company and the Said Alexander McFarlane,
We decern and ordain the Said Arthur Connell and Thomas Wallace
his pupile in the Event it Shall be found the Said John Pagan
and Company Stand indebted to the Said Alexander McFarlane as
their late factor in Maryland, To pay to the Said John Pagan and
Company one fifth part of Whatever Sum or Sums Shall hereafter
be found, Justly due to the said Alexander McFarlane by the Said
Company on a Settlement...
