John Finley, Gent. to Robert Finley, Gent., 297 acres on South River in Beverley

Manor, 22 May 1750, Augusta County, Virginia, DB 2:711.

 

This indenture made in the year of our Lord one thousand seven hundred and fifty between John Finley, gent. of the County of Augusta of the one part and Robert Finley, gent. of the said County of Augusta of the other part. Witnesseth that the said John Finley for and in consideration of the sum of 5 shillings current money of Virginia to him in hand paid by the said Robert Finley at or before the sealing and delivery of those presents the receipt whereof is hereby acknowledged, hath granted bargained and sold by those presents doth grant bargain and sell to the said Robert Finley one piece and parcel of land containing two hundred and ninety seven acres be it the same more or less lying and being in Beverly Manor in the said County of Augusta and on both sides of the South River of Shanando and bounded as followeth, viz. Beginning at two elms and a hicory corner to Israel Christian and land on the north side of said river and runeth thence with said Christian's line north ??? seventy one degrees west one hundred and fifty eight poles to his corner; a white oak by a meadow thence south twenty degrees west; twenty six poles with his line to his corner; a black and Spanish oak thence north--twenty one degrees west; one hundred and forty four poles with another of said Christian's lines to his corner between two white oaks; thence with Charles Dolways line south twenty nine degrees west; seventy five poles to white oak corner to William Finley's land--Finley's lines and corners south seventy five degrees; east one hundred and twenty five poles to a white oak; thence north eighty degrees east; fifty poles to a white oak and black oak on a side of steep hill; thence south thirty five degrees east; forty poles crossing said river between a white oak and walnutt near said Robert's house thence down the several courses of the river one hundred and eighty poles to a hickory and thence on the bank of the river thencefourth sixty eight degrees east; one hundred and four poles to two white oaks in the Manner line corner to said William Finley's land thence northeast twenty seven poles with a Manner line to two pines and a black oak above a red bank; thence north sixty degrees east; one hundred and sixteen poles with a line of Christian's land to a white oak and a black oak on bank of the river thence down the several courses and crossing the river with said Christian's land for beginning. And all houses buildings, orchards, waywaters, watercourses profits commodities and appurtenances whatsoever to the said premises hereby granted or any part thereof belonging or in any wise appurtaining and the reversion and reversions remainder and remainders - rents issues and profits thereof TO HAVE AND TO HOLD the said two hundred and ninety seven acres of land be the same more or less and all and singular other the premises hereby granted with the appurtenances unto the said Robert Finley his ex: Adm: and asignees from the day (?) before the date hereof forsaid during the full term and time of one whole year from thence representing fully to become compleat and ending and paying therefore throughout one year of Indian corn on Lady Day next the aforesaid shall be lawfully demanded to the interest and purpose that by which of those presents and of the statutes for transferring uses into possession the said Robert Finley may be in actual possession of the premises and better by enable him to receive and take a grant and release and the reversion and ??? thereof to him and his heirs in witness whereof the said John Finley hath hereunto set his hand and seal this day and year first above written.

At a court held for Augusta County the 22 day of May 1750 John Finley in open court acknowledged this his lease for land in ??? to Robert Finley which on his ??? is admitted to record and Mary his wife of the said John being first privately examined in open court relinquishes her right of dower to the land in the said leases mentioned which relinquishments is ordered to be verifyed and recorded with the said leases.
