John Finley et al vs Robert Christian for non-payment of The Reverand John

Craig's salary, May 1758, Augusta County, Drawer 402

 

John Finley, George Hutchinson, & John Christian, Surviving Commissioners for

collecting The Reverend Mr. John Craig's yearly salary Complain of Robert

Christian in Custody &. For that whereas the fourteenth day of August (?? in

Roman numerals) at the County aforesaid a certain discourse was had & moved by &

between the sd Plaintiffs together with James Patton & Alexander Brackenridge now

deceased and the sd Defendant, of and concerning the Reverend Mr. John Craig's

becoming their stated & fixed minister, and upon that discourse the aforesd

defendd in consideration that The Reverend Mr. John Craige would come from the

Province of Pensylvania to Augusta County in the Colony of Virginia and there

live as a ?? & settled Minister amongst the Inhabitents of the lower part of

Shand(?) in the County aforesd & do perform all the ministerial offices of

adjoenting(?) Clergyman he the said Defendant the day & year aforesd at the

County aforesaid ajoined upon himself & at the sd Plaintiff then & there

faithfully promised that he the sd Defendant would ??? & truly pay yearly and

every year towards the sd Plaintiff for the sd Mr. Craige's use fifteen shillings

Curr. money towards his support & maintainance, and the sd Plantiffs in fact say

that in pursuance of the agreement aforesd the sd Mr. John Craige did come

immediately from ye province of Pensylvania and settle & live & still does

continue ??? minister in the County of Augusta aforesd doing & performing all the

necessary duties becoming a good & Christian like Minister & preacher of the word

of God Nevertheless the sd Defendt his promise & ?? aforesd and made not

regarding but continuing & fraudulently intending the sd Plantiff in this behalf

?? & subtitng(?) to deceive & defraud the aforesaid yearly payment a sum of

fifteen shillings hath not paid (altho' often required) but ?? same to pay for

these sixteen year's last past before the commencement of this suit & of Issuing

out the Original Writ in this cause, hath refused to pay & still doth refuse to

the damage of the Plantiff Twenty pounds & thereof they bring suit.
