This Indenture made on the Second day of September in the year of Christ one thousand Seven hundred and ninety three between David Finley and Elizabeth his wife of the county of augusta and State of virginia of the one Part, and John Shields of the county of Amherst and State aforesaid of the other Part witnesseth that for and in Consideration of the Sum of one hundred twenty pounds which he the Said David Finley is Justly indebted to James Finley, and honestly Desires to Secure and pay to him and for and in the farther Consideration of the Sum of 5 Shillings like money: to the said David Finley in hand paid by the said John Shields at and Before the Sealing and Delivery of this the receipt whereof he doth hereby acknowledge, and thereof and of every part thereof doth exonerate and Discharge the said John Shields his heirs executor and administrators he the Said David Have granted bargained sold and Confirmed and by these Presents doth grant bargain sell and Confirm to the said John Shields his heirs and assigns for ever a certain tract of land lying the the County of Augusta which was Conveyed from Robert Clendening and wife to John Finley by Deeds of lease and release bearing Date the twenty first Day of March one thousand seven hundred and Seventy five and from John Finley to David by his last will and testament, Containing Seventy Six acres also one location of one hundred and ten acres Surveyed for Said David and for which he expects there is now a Patent issued joining the South west part of John Finleys old tract with all the appurtenances belonging or in any wise appertaining to the hereby granted or intended to be granted and the reversion and reversions remainder and remainders and all Serverces Benefits and Profits of the said Lands and Premises and all his rights claims interests and securities relating to the Same to have and to hold the said lands and other premises unto the Said John Shields his heirs and assigns for ever: to the only proper use and Behoof of him the said John Shields his heirs and assigns for ever. and the David Finley doth hereby grant for himself and his heirs that he the Said David and his heirs and every of them shall and will warrant and forever Defend the said Bargained tracts of land and other Premises and every unto the said John Shields his heirs and assigns forever against him the said David and his heirs and every of them and against every other Person whomsoever: upon trust nevertheless the said John Shields his heirs Executors Administrators or assigns shall after the 2nd Day of September in the year of Christ 1798 as soon as the Said John Shields his heirs Executors Administrators or assigns shall think Proper or the said James Finley shall request whichever of these two Circumstances shall first happen sell for the Best price that can begotten after given ten Days Public notice the said tracts of land and Premises and out of the money, arising from such Sale Discharge pay and satisfy to the said James Finley the aforesaid sum of one hundred and twenty pounds with legal interest from August one thousand seven hundred and ninety one untill the same shall be fully discharged and the expences attending the Drawing and Recording this Indenture and the Contingent Charges or the sale as aforesaid and other necessary expences that shall attend the securing and obtaining the above mentioned money or performing anything that is or shall be necessary relative to the intent of this indenture, and that the said John Shields his heirs, Executors, administrators, or assigns shall pay or cause to be paid the overplus if any remain from such sale to the said David Finley his heirs, Executors, administrators, or to his bider in witness whereof the said David Finley and Elizabeth his wife have hereunto set their hands and seals on the Day and year above written

At a District Court holden at Staunton September 1793 this Deed of trust David Finley and Elizabeth his wife to John Shields was acknowledged in Court She having been first privily examined as the Law Directs and is Ordered to be Recorded
