In the name of God Amen. I John Finley of the county of Augusta and state of Virginia being in an imperfect state of health, but of perfect mind and memory, do make and ordain this my last will, testament, first and principally I committ my soul to God who gave it, and my body to be decently buried at the discretion of my executors hereafter named, and as to my worldly estate, that it has pleased God to indow me with I give and bequeath as follows: and first of all, I allowthat my just debts and funeral expenses be discharged and paid and I give to my loving wife, Sarah Finley, my mention house and the third of my land whereon I now live, during her life and then to go to my two sons John & William in the ??? divide of said land as follows, which is to be divided equal in quantity according to quality and that William is to have his lot on the side joining his own land, I allow to said son John the whole of my land on Elkhorn in Kentucky, but providing the right of such land on Elkhorn should not prove good and the land be lost by prior rights or otherwise and not otherwise the land whereon I know live, I allow as follows, my son John to have two thirds of said land, and my son William one third in manner as above mentioned, as and that my said to sons John and William, each of them pay to my daughter Sally Finley ??? pounds to be paid at the end of two years after my decease, I allow to my two daughters Peggy Huchison and Sally Finley all my land on Dicks river in Kentucky to be equally divided in quantity according to quality, I allow to my daughter, Jinney Frasor my lot in the town of Waynsboro. I allow to my son John all the lands down on the waters Green river in Kentucky, yet notwithstanding if the right of the law on Elkhorn should prove good as left to my said son John I allow him ??? the one half of that on the waters of Green River, and the other half to be equally divided between my two sons Samuel and William, but if lost, I allow as above, and I allow to my son John all my shop tools, I allow my son William forty dollars which is to be made out of my stock horned cattle and I allow to my Sd son William my wagon and gears with all other plantation utensils and I allow to son John one dark bay filley, and I allow to daughter Sally one mare named Thunderbolt and all that part of the stock of cattle formerly named as hers, all my land above named to my children, I give to them their heirs and assigns forever, and I give to my loving wife Sarah Finley all the balance of my estate not above mentioned to dispose of among my children at what time and in manner she shall think best and I allow that something maydone for Peggy Mooney, and I do hereby alow my trusty friends William Finley and Andrew Ramsay to be my executors this my last will and testament and in witness thereof I have hereunto set my hand and seal this sixth day of July in the year, one thousand eight hundred and seven.

At a court held for Augusta County, December the 28th, 1807. The last will and testament of John Finley decd was proved by the oaths of Isaac MClure, Adam Russell, and the affirmation of David MClure three of the witnesses thereto ordered to be recorded.
