William Finley will, 25 February 1836, Will Book 21, page 291, Augusta Co., VA

 

I WM FINLEY of the county of Augusta and State of Va. being of sound mind but weak of body and knowing that it is appointed for all men once to die, do hereby make and publish this my last will and testament thus making void all former acts of this kind done by me - And first I direct that my body be decently intered and that my funeral be conducted in a manner corresponding with my estate and situation in life and as to such worldly estate as it hath pleased God to intrust me with I dispose of the same as follows. First I direct that all my just debts and funeral expenses be paid - I next direct that my sister Sarah Finley be paid out of my estate fifteen hundred dollars said sum is to embrace all debts whatsoever due from me to her. the said Sarah Finley to her paid as follows viz in five equal anual payments the first to be made as soon after my decease as can be done but not to exceed one year - in addition to her above: I direct that my sd sister have a full and sufficient support from my estate during life or so long as she is willing to continue a resident on my estate she must also be furnished with a good horse saddle & bridle. I direct that Margaret Mooney who is now residing with me a full and sufficient support on my estate during life. I next direct that my brother John Finley now residing in the State of Kentucky and my sister Jane Frazer late Jane Finley now residing in Ohio be paid each fifty Dollars said sums to be paid to my brother and sister three years after my decease. Next should my servants prove obstinate and ingovernable I direct that they be sold and the proseeds applyed to the payt of aforesd bequets reserving this priviledge for any man ??? that he have liberty of choosing his master next should the proseeds of my estate not be equal to the payt of my aforesd bequests I direct that my tract of land lying in said county lying below the turnpike in Rockfish gap and adjoining the land of ??? Bernard and others be sold another proseeds thereof be aplyed to the payt of sd legasys After the payment of all the above sd: I give and bequeath to Francis Marion Finley son to Margaret Mooney all the remainder of my estates whether real or personal to him the sd Francis M. Finley and to his heirs forever and lastly I nominate my sister Sarah Finley and Hugh McClure to execute this my last will and testament In witness whereof I Wm. Filey the testator have to this my will set my hand and seal the 25th day of Feb. one thousand wight hundred and thirty six

Augusta County Court December Term 1836

This last will and testament of Wm Finley decd was presented in Court and proved by the oaths of Joseph Peck and George B. Keiser two of the subscribing witnesses thereto and ordered to be recorded. And on the motion of Hugh McClure an executor therein named who made oath thereto according to law and with Joseph Peck and Samuel B. Kerr his securities entered into and acknowledged a bond in the penalty of eight thousand dollars conditioned as the law requires which bond is ordered to be recorded. certificate is granted to said Hugh McClure for obtaining a probate of said will in due force and leave is reserved to the execution therein named to qualify when she shall think proper to do so
