James Downing to William Downing, 212 1/2 acres on Meadows Creek in Bedford

County, VA, 6 September 1779, Bedford County Deed Book 7:236.

 

THIS INDENTURE made the Sixth day of September in the year of our Lord one

Thousand Seven Hundred and Seventy Nine Between James Downing of the County of

Montgomery of the one Part and William Downing of the County of Bedford of the

other Part Witnesseth the said James Downing for and in Consideration of the full

sum of Ninety Pounds Current Money of Virginia to him in hand Paid by the said Wm

Downing the Receipt whereof he the said James Downing doth hereby acknowledge

hath given Granted Bargained Sold and by these presents doth give Grant Bargain

sell deliver and Confirm to him the said William Downing his Heirs and assigns

forever One Certain Tract or Parcel of Land Situate Lying being in the County of

Bedford Containing Two Hundred & Twelve & a half acres on Meadows Creek Bounded

as followeth Beginning North Twelve degrees west One Hundred and four Poles to

Pointers on a Red Oak South Eighty Two degrees west one Hundred & Sixty four

Poles to a Shrub White Oak South Sixteen degrees East forty Two Poles to a Red

Oak. East one Hundred & Fifty Six Poles to a Shrub White Oak North Sixty degrees

East Seventy Poles to a white Oak on Meadows Creek aforesaid and up the same to

the first Station Together with all and Singular Priviledges and Pertenances

thereunto belonging or in any ways appertaining To Have & to Hold the abo. sold

Land and Premises with all the appurtenances unto the said William Downing his

Heirs and assigns forever To have and to hold use Ocupy Possess and Enjoy the

same with every part and Parcel thereof to him the said Wm Downing his Heirs and

assigns forever against him the said James Downing his Heirs and assigns and

against the Claim and Demand of all other Persons whatsoever shall and will by

these Presents Warrant and forever defend In Witness whereof he the said James

Downing hath hereunto set his hand and Seal the day and Year first above Written

MEMORANDUM That on the day & Year first within mentioned just and Feasible

Possession and Seizure of the within mentioned Land & Premises with all the

appurtenances was given & made by James Downing to Wm Downing In presence of the

Subscribing Witnesses whereof I have hereunto Set my hand and affixed my Seal.

At a Court held for Bedford County 28th February 1780 This Indenture together

with the Memorandum of Livery of S??? thereon indorsed were proved by the Oaths

of John Ewing and James Kennedy Witnesses thereto And at a Court held for the

said County the 25th day of August 1783 The said John Ewing and James Kennedy

came unto Court and made Oath that they saw Caleb Ewing the other Witness to this

Indenture (who is now decd) Sign the same as a Witness in their Presence

thereupon it is Ordered that the same be Recorded
