Dabney Finley of Lee County vs William Finley of Wythe County, recovery of slaves owned by Mary Pettus Finley, 15 January 1800, Wythe County, Virginia, Deed Book, 2:476-78.

 

Know all men by these presents that I Dabney Finley of the County of Lee, am held and firmly bound unto William Finley Senr. of the County of Wythe in the just & full sum of four thousand Dollars current money of the United States. To payment whereof will and truly to be made, to the said William Finley, his Executors administrators and assigns, I bind myself my heirs vc firmly by these presents. Witness my hand and Seal this 15th day of January 1800.

The Condition of this obligation is such that whereas the said William Finley by his intermarriage with his former Wife Mary, originally Mary Pettus, acquired sundry Slaves, from the Stock whereof he hath sold the following to wit, Caty to Manases Freel, Abby to George Wampley, Rachel, Sarah and Joseph, to said Dabney Finley, and Charles to William Hay, and is now possessed of the following to wit, Sal, Mourn(?), Hanna, Amy & Spencer & whereas doubts have arisen whether the right to the said Slaves is in the said William Finley absolutely or passes to the children of the said Mary formerly Mary Pettus, to wit Dabney Finley, Rhoda Finley, Margaret Finley, John Pettus Finley and Asa Finley and to prevent controversy it has been agreed that the said William Finley shall convey and release to the said Dabney, Rhoda, Margaret, John Pettus & Asa the remaining Slaves, Sal, Mourn (?), Hanna, Amy & Spencer and that the said Dabney, Rhoda, Margaret, John Pettus and Asa shall set upon a claim to the said Slaves Caty, Abby, Rachel, Sarah and Joseph & Charles, whom the said William Finley hath sold, now therefore if the said Dabney, Rhoda, Margaret, John Pettus and Asa shall fail as to make any claim to the said Caty, Abby, Rachel, Sarah and Joseph or Charles, or either of them, as if the said Dabney Finley shall save himself and indemnify the said William Finley from any such claim should it be made then the above obligation shall be void, or else shall remain and be in full and compleat force effect and virtue.

The penalty made four thousand I will be Security for the Dollars the words "acquired" in performance of D. Fnley the third "& Charles" in the 21st & Charles in the 25th inter??? William Finley (seal) before signing.

Know all men by these presents that I William Finley the ?, of the County of Wythe for, and in consideration of the natural love and affection which I have and bear unto my children Dabney Finley, Rhoda Finley, Margaret Finley, John Pettus Finley & Asa Finley, born of Mary my former Wife, I have given granted, released & confirmed, and do by these presents give grant release and confirm, unto the said Dabney, Rhoda, Margaret, John Pettus, and Asa the five following Slaves, to wit Sal, Mourn(?), Hanna, Amy & Spencer, which Slaves or their progenitors I received in marriage with the said Mary my former Wife and which Slaves I hereby confirm to the said Dabney, Rhoda, Margaret, John Pettus and Asa and their heirs and assigns forever To the sole and proper use and behoof of the said Dabney, Rhoda, Margaret, John Pettus & Asa and of their heirs and assigns forever, and I hereby for myself and my heirs covenant with the said Dabney, Rhoda, Margaret, John Pettus & Asa and their heirs, that I will warrant the said Slaves to them and their heirs or assigns against myself & my heirs & all persons claiming this by ??? under me, & I do by the delivery of this Instrument transfer to the said Dabney, Rhoda, Margaret, John Pettus & Asa possession of the said Slaves. In testimoney whereof I have hereunto set my hand and Seal this 15th day of January A.D. 1800.

At a Court continued and held for the County of Wythe the 15th day of January 1800 This Deed of Gift from William Finley to Dabney Finley, Rhoda Finley, Margaret Finley, John Pettus Finley & Asa Finley was acknowledged in Court by the said William Finley and thereupon ordered to be Recorded
