This INDENTURE made this Fifteenth day of February and year of our lord one

thousand seven hundred and ninety one between James Downing and Nancy his wife of the County of Lincoln and State of Virginia of the one part and Ezekiel Downing of the County of Lincoln and State aforesaid of the other part WITNESSETH that the said James Downing and Nancy his wife for and in consideration of the sum of sixty pounds current money of Virginia to them in hand paid by the said Ezekiel Downing the receipt whereof he the said James Downing and Nancy his wife doth hereby acknowledge and themselves therewith fully satisfied and content hath granted bargained sold aliened and confirmed and by these presents doth grant bargain sell alien and confirm unto the said Ezekiel Downing his heirs or assigns forever one certain tract or parcel of land containing sixty seven and one half acres by survey be there more or less situate lying and being in the county of Lincoln and on the waters of Clear Creek waters of Dicks River being part of Asel Davises settlement and preemption same patented in the said Davises name and by him deeded to said James Downing and bounded as follows to wit BEGINNING at a Beech and white oak tree standing in James Downings line and North West Corner of William Montgomerys land and with his line South one Hundred and sixty five poles to an elm sugar tree and hackberry trees William Montgomerys south west corner standing on Robert Montgomerys line and with the same west(?) sixty four poles to a hickory and hornberry(?) standing in Jack Copelands line and a corner to Asel Davises land and with his line North one hundred and sixty four poles to a hickory and white elm tree standing in said Davises line and south west corner to James Downings land and with his line East sixty nine poles to the Beginning with its appertenances To Have and to Hold the said land and premises with all and every of its Appertenances unto the said Ezekiel Downing and his Heirs forever and the said James Downing and Nancy his wife for themselves their Heirs Executors and administrators the said land and premises unto the said Ezekiel Downing his heirs Executors and administrators ???? and will warrent and forever defend against the claim of him the said James Downing and Nancy his wife their Heirs Executors and administrators or from any other person or persons claiming by or ???? him or them and against the claim or claims of all and every other person or persons whatever In Witness whereof the said James Downing and Nancy his wife for themselves their Heirs Executors and Administrators hath hereunto set their hands and affixed their seals the day and year first above written

At a Court held for Lincoln County the 15th day of February 1791 This Indenture was acknowledged by the said James Downing and Nancy his wife she being first prively examined as the law directs to be their act and deed and ordered to be recorded. V.D.D.
