Samuel Finley of Fayette County Agreement with William Sudduth of

Clarke County, KY, concerning 500 acres Finley obtained from Jacob Myers,

27 September 1796, Clarke County, KY DB 2:42.

 

Be it Remember'd that the following agreement is this day inter'd into between Samuel Finly of the County of Fayette & State of Kentucky of the one part and William Sudduth of the County of Clarke and State aforesaid of the other part Witnesseth that the said Finley has a deed on a certain Jacob Myers of Kentucky for five hundred acres of land which he has this day put into the hands of the said Sudduth for said Sudduth to endeavour to obtain land or other property of the said Myers for as the land conveyed by said Myers to Finley in said deed is taken by prior claims the said Finley agrees to give the said Sudduth one fifth part of whatever he shall obtain by virtue of said claim against the said Myers & if the said Sudduth should obtain no land nor property in leiu thereof he is to loose his trouble but should said Sudduth have occasion to advance any money in endeavouring to settle said business the said Finley agrees to refund the same & for the true performance of the above contract we bind ourselves our Heirs & eich to the other in the penal sum of five hundred pounds Current money of Kentucky Witness our hands and Seals this 27 day of September 1796
