Order Books

 

7 June 1813 - A deed from Samuel Finley and wife to William Finley of Augusta County Virginia for land lying in said county was this day acknowledged in open court by the said Samuel Finley to be his act and deed which is ordered to be certified to all whom may concern;

20 January 1834 - On motion of Jno T. Finley admin is granted him on this Estate of Saml Finley decd the widow of said decedant refusing to qualify. And the said Jno T. Finley came into Court and took the oath required by law. And Entered into and acknowledged Bond in the penalty of Eight thousand dollars con(?) with Jno. T. Finley, his secy conditioned according to law. And on his motion Austin Bradford .... if any and report to Court.OB

21 August 1837 - On motion of B.F. Finley and Wm (T or S) Hood administration is granted them on the Estate of John Finley Sr deceased and they came into Court and Entered into and acknowledged his bond in the penalty of three thousand dollars with Jno T Finley and Saml Walker their Securities Conditioned according to law And on their motion it is ordered that Henry Hann Wm Rosell Parker Otwell Jno Hill or any three of them being first duly sworn he and they are hereby appointed comrs to appraise the personal Estate and Slaves if any of said decedant and report to Court. Jno O. Pew returned his list of taxable property which is ordered to be certified to the Auditor of Public Accounts.

On motion of Elizabeth Finley widow of Jno Finley decd it is ordered that J.H. Humphreys Wm Rosell (Rozell?) G.K. Smith and John Hill or any three of them being first duly sworn be and they are hereby apptd comrs to the dower of said Elizabeth in the Estate of said decedant.

Ordered that the clerk proceed to copy the Order Books of the Court which have been burnt and file carefully away the old books or so much thereof as can be preserved; OB D:5.

11 September 1837 - John Finley inventory and appraisment; names W.A.J. Simpson, Thomson Findly, Elizabeth Finley, Mariah I.(?) Finley, Thomas Sherett; 3 slaves valued at $1650; presented at October County 1837; appraisers were Wm Ropell, Parker Otwell, John Hill; Scott County, KY WB F:42.

 

12 September 1837 - John T. Finley deceased, sale of personal estate; names S.F. Gaines, James Griffith, James H. and Franklin Finley, John Hill, S. Henry, John Kyle, S.B. Menifer, Saml Walker, I Bowman, Jno S. Finley, Otho Offutt, Edward Clarke, Ford, William Rozzell; Geo. Gaines, Danl Hume, Jno Gano, Wm Holland; presented at October Court 1837; Scott County, KY WB F:42-46.

 

April Court 1839 - John T. Finley deceased, settlement; We the undersigned Coms would Respectfully Report that we met at the Clerks Office on the 13th March 1839 and settled with the Adms of John T. Finley decd and make the amended amount a part of our Report. We find a balance on their hands of $2279.74 amt deducting 1/3 for the widows part leaves the sum of $1521.83 which being divided Amongst 4 Heirs gives to each child $380.46 (amended to be $375.32); Ren B. October Court 1839 - Copy of will of John Finley of Augusta County, dated 6 July 1807 was sent to Scott County, KY on 15 September 1810; acknowledged in Scott County October 1839 saying the original will of record was destroyed, but certified copy examined and ordered recorded; Scott County, KY

16 October 1843 - I Joseph Walker Finley of the County of Scott State of Kentucky do make this my last will and testament in manner and form as follows. It is my will that should I die without issue that my Brother Benjamin Franklin Finley shall have my whole estate both real and personal that I am now possessed of or that I may hereafter acquire this 16th day of October 1843. Finley decd was this day produced in open court and the body of said will and the signature were proven to be wholy in the handwriting of said decedant by the oaths of William A. Elizabeth Finley, widow of John S. Finley deceased, deed of conveyance to James H. Finley and Benjamin Franklin Finley, 11 September 1837, Scott County, KY DB O:116.

 

This Indenture made and entered into 11th day of September in the year of Christ 1837 Betwext Elizabeth Finley widow of John Finley decd late of Scott County Kentucky of the one part and James H. Finley and Benj Franklin Finley of the County and State aforesaid of the other part Witnesseth that the said Elizabeth Finley for the consideration of one dollar to her in hand paid the receipt whereof is hereby acknowledged and the further consideration hereafter mentioned do by these presents part bargain Sell convey and deliver possession to the said James and Franklin all her right title and interest in and to the landed estate of her decd husband aforesaid lying in Scott County Kentucky being the tract of land upon which the said John S. Finley decd also all her right title and interest in the following Slaves (Viz) Westley Milley Aia and her three children which are the property of the said decd at his death together with all her right title interest or claim to all the personal estate choses in action vc. and all claims of every discription either dower or otherwise to all other property whatever which she may have hereafter or now has on the estate of the said decedent - To have and to hold the said James H and Benj Franklin Finley and their heirs forever - the further consideration being as follows, the said Finleys of the last part have agreed to pay to the said Elizabeth of the first part five hundred dollars on the 11th day of September 1838 five hundred dollars on the 11th day of September 1839 and five hundred dollars on the 11th day of September 1840 They having Executed to the said Elizabeth their three several promisary notes for the payment of the above sums - In Testimony whereof the said Elizabeth hath hereunto set her hand and affixed her Seal this day and date first above written
