Micajah Harrison to Daniel Ford, 850 acres, heirs of James Downing,

This Indenture made this 10th day of April 1817 by and between Micajah Harrison Commissioner of the one part and Daniel Ford of the other part all of the State of Kentucky witnesseth that the said Daniel Ford lately recovered a Decree in the Montgomery Circuit Court for certain tracts or parcel of land from the heirs of James Downing deceased namely Richard Boyed and Polly his wife late Polly Downing, Johnson and Nancy his wife late Nancy Downing, Thomas Cochron and Margaret his wife late Margaret Downing, Thomas Thompson and Elizabeth his wife late Elizabeth Downing, James Blair and Selphid his wife late Selpha Downing, Samuel Finley and Patsey his wife late Patsey Downing, Isaac Preston and Salley his wife late Salley Downing and Rachel Downing, James Downing, Setchey (Celia?) Downing and Sidndee Sidney Downing in fact heirs of said James Downing deceased and they failed having to file and neglected to convey the said land to said Daniel Ford agreeable to said Decree and whereas the Montgomery Circuit Court for the purpose of carriage their Decree into effect and causing a conveyance to be made appointed the aforesaid Commissioner to convey the same for and on behalf of the said heirs of James Downing deceased now therefore he the said Commissioner by Decree of the authority vested in his by said decree and in consideration of the premises have sold and conveyed and by these presents doth grant bargain sell and convey alien and confirm to said Daniel Ford all the right title and interest of the said heirs aforesaid to and in that parts or parcels of land lying and being in the County of Madison between Paint Lick and Silver Creek and bounded as follows Beginning at two white oaks and South East corner of said Downing survey and comes to Crigs? original Survey thence with Downing original line north 25 west 220 poles to an oak dogwood and walnut corner to Stephen Salleys 200 acre Tract which was taken out of said Downings Survey thence with said Salleys line South 76 west 302 poles to an elm and hickory corner to said Salley near the Ridge Road thence with said Salleys north 14 west 54 poles to two Sugar trees corner to 200 acres laid off for Jesse Burton thence with said Burtons lines South 69 west 170 poles to a Sugar tree and oak corner to Isaac Burton deceased 100 acres thence with his line South 20 East 120 poles to two beech trees corner to said Burton thence ..?.. line north 69 East 54 poles to a Sugar tree and Elm thence South 23 East 152 poles to three Sugar Trees on the old line dividing Downing and Crig and branch thence with said old line north 74 East 432 poles to the Beginning Containing 680 acres and the other parcel which contains 170 acres, in bounded as followeth to wit. Beginning at a hickory and two Sugar Trees standing on the line of 100 acres allotted to Isaac Burton deceased and South west comes to Jesse Burtons 200 acres thence with his line north 14 degrees west crossing a creek 146 poles to a stake on the old line of Downing and Bledsoes Survey and a hickory and Sugar trees ...?... thence with said old line South 69 west 230 poles to a Stake and two hickorys Supposed to be the original corner of Downing and Bledsoe on Alcocks old line thence with said old line South 37 East 140 poles to an ash and Sugar trees original corner to said Alcocks and Downing thence north 68 East 82 poles to a Forked Elm Stump on a branch corner to Thomphens old Survey thence South 23 East 35 poles to a dogwood at the north west corner of said Isaac Burtons corner to his 100 new Tract thence south the same north 54 East 72 poles to the Beginning Containing in both parcels Eight hundred and fifty acres with the appurtenances To have and to hold the said Tracts or parcels of land to the said Daniel Ford and his heirs forever To his said thus only proper use and behoof under the said commissioner for the said heirs and ...?... the said parcels of Land to the said Daniel Ford will forever warrant said defend against all and Every person ...?... by from or under said heirs or their Father or any other person or Claim whatsoever but without any warranty as to said Commissioner and without any recourse to him In testimony whereof the said Commissioner hath hereunto Set his hand and affixed his Seal as Commissioner aforesaid the day and date aforesaid.

Note the name Joseph erased and Daniel inserted ...?... the place where Joseph occurs ...?... in several places are entered before signed. At Harrison Comn.

At a Circuit Court held for the Circuit of Montgomery in April 1817 This Deed was ...?... by Micajah Harrison a Commissioner appointed for that purpose and the sam is duly recorded in my office which is hereby certified to the Clerk of Montgomery County to be there recorded. Given under my hand as Clerk of the said Circuit Court at the Term above written.
