John C. Finly and Thomas Townsend to Caleb Butler, three acres on Muddy Creek,

1 September 1834, Madison Co., KY, Book v:399-400.

 

This Indenture made and entered into this 1st day of September 1834 by and between John C. Finly and Thomas Townsend of the one part and Caleb Butler of the other part witnesseth that for and in consideration of the sum of $700. to them the said Finly and Townsend in hand paid by the said Butler the receipt whereof is hereby acknowledged (that is to say the sum of $15. to the said Townsend and the sum of $685. to the said Finly) hath granted bargained and sold and by these presents doth grant bargain and sell unto the said Caleb Butler a certain tract or parcel of land situate lying and being in the County of Madison and on the waters of Muddy Creek and bounded as follows to wit Beginning at an elm tree thence running up the Log Lick branch to a Spanish oak at the fall of said branch thence running North of said branch to Townsend and Embrys back line containing three acres be the same more or less, together with his the said Finlys wool carding establishment entire with the exception of one set of carding engines which the said Finly hereby reserves to himself, but hereby conveys all the balance of said establishment and the land aforesaid, with its appurtenances and premises unto the said Caleb Butler and his heirs forever, and the said Townsend and Finly doth hereby warrant and will forever defend the title of said land against the claim or claims of all and every person or persons whatsoever. In testimony whereof we have hereunto set our hands and affixed our seals the day and date aforesaid.

I David Irvine Clerk of the Court for the County aforesaid do hereby certify that this deed of conveyance was produced to me in my office on the 1st day of September 1834 and acknowledged by John C. Finly to be his act and deed, and forever to be the act and deed of Thomas Townsend by the oaths of Montreville Hoff and Hiram Townsend both subscribing witnesseth thereto and the same has been duly recorded in my office.
