This Indenture made and entered into this 31 day of November 1841 between Richard Boyd and Polly his wife, Arthur Johnson and his wife Nancy, Thomas Cochran and Margaret his wife, Thomas Thompson and Elizabeth his wife, James Blair and Selpha his wife, Samuel Finley and Patsey his wife, Isaac Preston and Sally his wife, Cyrus Finley and Rachel his wife, James Downey, Celia Downey and Moses Poor and Siddy his wife by Stephen Nolan, commissioner appointed by the Madison Circuit Court of the first part, and Daniel Ford of the second part, Witnesseth; That whereas by a decree of the Madison Circuit Court rendered at its June Term 1841, in two Chancery causes, one Daniel Ford against James Downey's heirs, and the other James Downey's heirs against Daniel Ford. vc it was decreed and ordered that the grantors in this deed should on or before the first day of the next term of said Court convey to the grantee Ford by quit-claim the land in the bond on file in said causes, and also embraced in the Commissioner Harrison's deed to Ford on file in said causes, and of their failure to do so, the Commissioner aforesaid was appointed to make said conveyance on their behalf; and they having failed, therefor, in consideration of the decree and premises aforesaid, the grantors aforesaid hereby convey to said Daniel Ford the land contained in the bond on file in the causes aforesaid from James Downey to Obadiah Bondurant(?) and Daniel Ford dated 3 April 1816, and embraced by the deed on file from Micajah Harrison, Commissioner, on behalf of James Downey's heirs to Daniel Ford, dated 10 April 1817, and is described as follows in said deed, to-wit:

To have and to hold the lands aforesaid to the said Daniel Ford, and his heirs forever. It is understood that the grantors in this deed are not to be responsible for title, as they only convey the title of their ancestor James Downey, deceased, and the Commissioner is not to be responsible to any extent.

I David Irvine, Clerk of the Court for the Circuit aforesaid do hereby certify, that at a Circuit Court, held for Madison County on the 30 day of November 1841, this deed of conveyance was produced in open court, and acknowledged by Stephen Noland as Commissioner, to be his act and deed; which was examined and confirmed by the Court, and ordered to be recorded, and the same has been done accordingly
