To All who shall see these presents I John Callaway Sheriff of the county of Knox in the state of Tennessee send Greeting
Whereas a writ of fieri facies issued from the County Court of pleas and quarter sessions for the county of Greene bearing test the fourth monday in July one thousand eight hundred and eighteen and issued the 27th day of July 1818 to me directed by which I was commanded that of the real estate or lands & tenements which was or were of William King deceased and which was or were devised or descended to Thomas Claiborne and Sarah his wife late Sarah King widow and relict of James King deceased William Thomas and Eliza King infant children of the said James King deceased Connelly Findley and Nancy his wife John Mitchell William Heiskell and Eliza his wife John Polly and Rachell Mitchell infant children of the said John Mitchell by his wife Elizabeth deceased Joseph Trigg and Elizabeth his wife late Elizabeth Findlay John Allen and Hannah his wife William Connelly Daniel and Lilburne Trigg infant children of William Trigg deceased by his wife Rachel William James and Thomas King infant children of Samuel King deceased in my county being I should cause to be made the sum of three thousand two hundred and fifteen dollars twelve and one half cents the residue of a judgment recovered in said court by Alexander Fulton together with interest on the whole debt of six thousand seventy nine dollars and twenty seven cents from the first day of November last past till the twenty fourth day of July 1818 and from thence untill paid on the residue aforesaid and the furthur sum of forty cents for said Fieri Facias And whereas by virtue of said writ and to comply with the command therein contained I as Sheriff by my deputy John R. Nelson did levy the same amongst other real estate on a piece or parcel of land being part of a tract granted by the state of North Carolina to David Walker containing thirty eight and one half acres be the same more or less lying in the said county of Knox on the north side of Holston river the waters of Third Creek And whereas to with on the nineteenth day of September one thousand eight hundred and eighteen at the Court house in Knoxville in said county of Knox I as sheriff by my said deputy in pursuance of my duty and by virtue of said writ of Fieri Facias and to comply with the command therein contained having first given legal notice of the time and place of said sale did expos to public sale said piece or parcel of land before mentioned for ready money to the highest bidder And whereas at and upon said sale John Clark of the City of Augusta state of Georgia bid and offered for said land the sum of one hundred and eighty dollars which was the highest and last sum bid for said land and therefore said John Clark became the purchases thereof.
Now Know Ye that I the said John Callaway Sheriff as aforesaid in consideration of the premises in pursuance of the powers vested in me by law and to comply with my duty as sheriff and in consideration of one hundred and eighty dollars to me in hand paid by said John Clark have granted bargained sold aliened enscoffed conveyed and confirmed and by these presents do grant bargain sell alien enscoff convey and confirm unto the said John Clark his heirs and assigns forever said tract or parcel of land being part of a tract granted by the state of North Carolina to David Walker of one hundred acres lying and being in the county of Knox aforesaid on the north side of Holston river the waters of third creek beginning on a pine at the spring where Luke Lee formerly lived running thence north one hundred and nine poles to a post oak thence south eighty three degrees east ninety eight poles to a white oak thence south nineteen poles to a red oak on a small drain and from thence to the beginning containing thirty eight and one half acres be the same more or less together with all and singular the hereditaments and appurtenances to said piece or parcel of land belonging or in any wise appertaining and also all the right title interest estate property claim and demand of them the said Thomas Claiborne and Sarah his wife late Sarah King widow and relict of James King deceased Wiliam Thomas and Eliza King infant children of James King deceased Connelly Finly and Nancy his wife John Mitchell William Heiskell and Eliza his wife John Polly and Rachell Mitchell infant children of the said John Mitchell by his wife Elizabeth deceased Joseph Trigg and Elizabeth his wife late Elizabeth Finley John Allen and Hanah his wife William Connelly Daniel and Lilbourne Trigg infant children of William Trigg deceased by his wife Rachel and William James and Thomas King infant children of Samuel King deceased heirs or devisees of said William King deceased and of each and every one of them. To have and to hold said piece or parcel of land together with the hereditaments and appurtenances to them and each of them respectively belonging to the said John Clark his heirs & assigns forever against the lawful title claim and demand of said heirs & devisees and of each of them and against the lawful title claim and demand of all and every other person or persons whomsoever so far as I as sheriff consistent with my duty can authorize him to hold the same.
In testimony whereof I the said John Callaway have hereunto subscribed my name and affixed my seal this ninth day of April in the year of our Lord one thousand eight hundred and nineteen.
