Samuel Finley of Madison County, MS Terr. to James Finley

and
Joseph Culbertson of Chambersburg, Franklin County, Pennsylvania,
his eighth part of 27 acres inherited from James Finley, decd; 19 September 1816,
Franklin County, PA, DB 12:167- 168.



This Indenture made the nineteenth day of September one thousand eight
hundred and sixteen between Samuel Finley of Madison County Mississippe
territory of the one part and James Finley & Joseph Culbertson of
Chambersburg Pennsylvania of the other part Whereas James Finley Esquire
late of Franklin county, Pennsylvania, deceased father of the said Samuel
died intestate so far as respects a certain piece or parcel of land situate
in Letterkenny township, Franklin county aforesaid bounded by lands of
Frederick Hess, Abraham Risor's heirs, John Finley's heirs and other land of
the said James Finley, decd containing twenty seven acres and allowance more
or less which was conveyed to the said James Finley, decd by Joseph
Culbertson by deed dated the third day of April one thousand eight hundred &
ten recorded at Chambersburg in book vol. 9 page 157 by reason when the said
Samuel Finley entitled to the undivided eighth part thereof as one of the
heirs of the said James Finley decd Now this Indenture Witnesseth that the
said Samuel Finley for and in consideration of the sum of one hundred
dollars to him in hand paid by the said James Finley & Joseph Culbertson the
receipt whereof is hereby acknowledged hath granted bargained & sold and
hereby doth grant bargain & sell unto the said James Finley and Joseph
Culbertson their heirs and assigns all the undivided eighth part of the
forgoing described piece or parcel of land with the appurtenances. To have
and to hold the said premises hereby granted & the appurtenances and the
right title interest claim & demand of him the said Samuel Finley either in
law or equity of in to a part of the same to the said James Finley & Joseph
Culbertson their heirs & assigns forever as tenants in common and not as
joint tenants: and the said Samuel doth hereby covenant that he and his
heirs the premises hereby granted to the said James & Joseph & their heirs &
assigns against all persons lawfully claiming shall & will warrant & forever
defend. In testimony whereof the said Samuel hath hereto set his hand &
seal the day & year first aforesaid.

James Finley and Joseph Culbertson to Samuel Finley, 1816


Recd of James Finley and Joseph Culbertson the sum of one hundred dollars in
full of the consideration of the above deed, Samuel Finley, Franklin county
Personally appeared the within mentioned Samuel Finley before the subscriber
a justice of the peace in and for said county and acknowledged the writing
as and for his act & deed for the purposes therein mentioned allowing the
same as such to be recorded according to law. In testimony whereof I have
hereto set my hand and seal this 19th day of September 1816

A true copy taken from the original which was left on the 11th day of March
1818 to be recorded but was mislaid by taking it into Court for the purpose
of exhibiting it there as evidence in a certain matter and, the same is now
recorded as of the 7th day of February A.D. 1819
