James Finley Will, 16 January 1806, Mecklanburg County, NC

In the names of God Amen. I James Finley of Mechlanburg County being at present

sick & weake in body, but of Sound and disposing Memory, Blessed be God, and

calling to mind the mortality of the body, & that is appointed, for all men once

to die, do make & ordain this my last will & Testament in manner & form

following, viz. First of all I recommend my soul to God who gave it, and my body

to the Earth to be buried in a Christian like & decent manner, at the descretion

of my Executors herein afternamed, & as touching such worldy Estate as it hath

pleased God to Bless me in this life, I give and dispose of the same as follows,

First I will that my just debts be paid & discharged as soon as convenient after

my decease. Imprimis. I give and bequeath unto my son William, a part of the

Land I now live on to be laid off to him in the following manner, viz. Beginning

on my line where it crosses the road leading from my house to the house of John

Gordon, and runs So. 45 East to a Hickory, thence N. 55 East with Mason M

Whorter's old line, crossing the Creek to a Hickory M Whorter's corner, thence N

45 west 54 poles to a Red Oak, old M Whorter's Corner, thence to the corner of my

field ???? to old M Whorter's thence with the Side of old field to a lick by the

Creek thence Crossing sd Creek and up the side of the old Creek to the mouth of a

small branch, thence with the various meanders of the sd branch the aforesaid

Road, thence to the Beginning. Supposed to be about fifty acres ...... unto my

son-in-law Thomas White the Land he now live on containing one hundred acres be

the same more or less, to him and his heirs forever in Fee simple. Item I give

and bequeath unto my Daughter, Jennet, the remainder of the Land I now live on,

together with forty acres ajoining the same, to her and her heirs forever, in Fee

Simple. and as to my son Charles & my Daughter Martha wife to Daniel Roberts as

having given them formerly Land & I make no further provision for them in this my

will, I likewise leave unto my Daughter Jennet, all my stock of horses, Cattle, &

Hoggs & Plantation tools & farming ???? , my household & Kichen furniture, and

all outstanding debts due to me, and all or any property belonging to me not

herein before mentioned, She ??? out of the same the following sums viz. To my

sons James, John & George to each of them one Dollar, if they come to receive the

same within 12 months after my decease, and to my Daughter Sarah wife to William

Chaple one Dollar, and to my former son-in-law Henry Harget(?) on Dollar and

finally, I do hereby nominate my Daughter, Jennet, the sole Execution of this my

last will and Testament, hereby revoking all former wills by me heretofore made.

In Witness whereof I have here unto set my hand & affixed my Seal this 16th day

of January 1806.

Signed, Sealed & acknowledged by the sd James Finley to be his last Will and

Testament I the presence of us ???his ??? have subscribed our names as Witnesses
