James and Sarah Downing of Stark County, OH to William Hewit and John Beatty of
Brooke County, VA, 150 acres, 29 October 1810, Brook County Deed Book 4:376.
THIS INDENTURE made this twenty ninth day of October in the year of our Lord one
thousand eight hundred and ten Between James Downing and Sarah his wife of the
county of Stark and State of Ohio of the one part and, William Hewit and John
Beatty of the county of Brooke, and State of Virginia of the other part.
Witnesseth that the said James Downing and Sarah his wife for and in
consideration of the sum of two hundred dollars to them in hand paid by the said
William Huet and John Baity the receipt whereof is hereby acknowledged have
granted bargained and sold bargain and sell, release and confirm unto them the
said William Huet & John Beatty a certain tract or parcell of land situate lying
and being in the county of Brooke aforesaid, and on the waters of White Oak run
being part of a tract of land containing three hundred and seventy seven acres
for which the commonwealth of Virginia granted a Patent to the said James Downing
bearing date the twentieth day of July 1802, Bounded as followeth, to wit.
Beginning at a sugar tree on the line at the originall survey, thence North 72
degrees, East 80 poles to a white oak thence North 84 degrees, East 44 perches to
a sassafrass thence South 24 degrees East 184 perches to a stake, thence North 24
degrees East 82 perches to a Black oak, thence North, 26 degrees west 234 perches
to a stake, thence North 65 degrees West 134 perches to a white oak, corner to
James Hibbit, thence South 15 degrees, west 87 perches to the Beginning
containing one hundred and fifty acres, together with all and singular the
appurtenances thereunto belonging or in any wise appertaining to have and to hold
the said tract or parcell of 150 acres of land with the teniments(?)
hereditaments and all and singluar the premises herein before mentioned or
inter??? take bargained and sold and every part and parcell thereof with every
???? members and appurtenances unto the said William Hewit and John Beatty their
(heirs) and assigns forever to the only proper use and behoof of them the said
William Hewit and John Betty their heirs and assigns forever, and the said James
Downing and Sarah his wife for themselves their heirs Executors the said tract or
parcell of one hundred and fifty acres of land herein before described with all
and singular the appurtenances thereunto belonging unto the said Wm Huet and John
Beaty their heirs and assigns free from claim or claims of all and every person
or persons whatsoever, shall will and do warrant and forever defend by these
presents. In witness whereof the said James Downing and Sarah his wife have
hereunto set their hands and seals the day and year first above written.
