Heirs of James Downing, Deed of Conveyance, 2 December 1822, Stark County, OH, Deed

Whereas James Downing Late of Stark County Ohio decd during his life time and thetime of his
death was seized and possessed of in fee simple all the follwoing described tract of Land to wit
the North west quarter of section number twenty nine Township seventeen of Range number
seven The North East quarter of the same section The South East quarter of Section number
thirty in Township in Township number sixteen of Range number seven and whereas the said
James Downing Left as his heirs at Law to wit Drusilla who is intermarried with Isaac Miller
Margaret who is Intermarried with Benjamin Cuppy Susanna who is Intermarried with Isaac
Vanmeter James Downing and Nancy his wife Hugh Downing and Mary his wife Adam Downing
and Sarah his wife and Sarah who is intermarried with Robert Thompson whereas the said heirs at
Law of the said James Downing decd here mutually agreed to divide said Real estate and have
agreed that the same be held in severally by said heirs as follows That the said James Downing
should have the said North East quarter of Section number twenty nine in the seventeenth
Township and the seventh Range That Hugh Downing should have the southeast quarter of
Section number thirty in Township number sixteen of Range Number seven That Adam Downing
should have the North West quarter of section number twentynine Township number seventeen
Range number seven and that a certain trat of Land in Brook County Virginia of which the said
James Downing also seized possessed should be sold and the proceeds divided among said heirs
as follows to pay to each of the daughters of said James Downing decd the sum of two hundred
dollars - and that the residue of said proceeds be equally divided among all the said heirs Now
therefore to confirm said Division so made as aforesaid and for and in consideration of the some
of one dollar to us Isaac Miller and Drusilla his wife Benjamin Cuppy and Margaret his wife Isaac
Vanmeter and Susanna his wife and James Downing and Nancy his wife Hugh Downing and Mary
his wife and Robert Thompson and Sarah his wife in hand paid by Adam Downing the Receipt
whereof is acknowledged and for the further consideration of the said Division to us made as
above mentioned have given granted bargained sold and by these presents do give grant bargain
sold unto him the said aforesaid North west quarter of Section number twenty nine in Township
number Seventeen of Range number seven to be held by him his heirs and assigns forever in
severally to the only proper use benefit and behoof of him the said Adam Downing his heirs
assigns forever as a good perfect and absolute - in fee simple and we will warrant and defend the
same to him the said Adam Downing his heirs and assigns forever against all persons claiming the
same in any manner whatsoever - In Witness whereof and hereunto sign our names and affix our
seal this the second day of December in the year of our Lord one thousand eight hundred and
twenty two.

Personally appeared before me the undersigned acting Justice of the peace from said County the within named Isaac Miller James Downing Hugh Downing and Robert Thompson who acknowledged that thea did voluntarily sign seal and deliver the within deed of conveyance for the full purposes therein expressed Also Personally appeared before me the Drusilla Margaret Susanna Sarah Nancy and Mary Ann wives of the said Isaac Miller James Downing Hugh Downing and Robert Thompson and being examined separate and apart from their said husband acknowledged the within Deed of conveyance to be their voluntary action and that thea executed the same [without] threats coertion or persuasion of their said husband and freely relinquished their Rights of Dower to the premises therein mentioned and desired the same may be admitted to record Given under my hand and seal December the 2nd one thousand eighteen hundred and twenty two
