Now at this day comes the Plaintiff aforesaid by his attorney but the said
defendants although solemnly called comes not but makes default. It is therefore
considered by the Court here that the said Plaintiff ought to recover against the
said defendant and because it is suggested and manifestly appears to the Court
here that the said plaintiffs demand is liquidated and certain and that the same
is founded on an instrument of writing purporting to be executed by the said
defendant and that the said defendants are justly in debt to the said Plaintiff
in the sum of thirty four Dollars fifty cents for his debt and also the sum of
four Dollars and five cents for his damages. It is therefore considered that the
said Plaintiff recover against the said defendant James Findley and also against
John Findley and Samuel Findley who are security in the appeal bond as well the
said sum of thirty four Dollars and fifty cents for his debt and four dollars and
five cents for his damages as also his costs and charges in and about his suit in
this behalf income laid out and expended and that he have there of Execution.
