The People of the State of New York by the grace of God free and independent To all to whom these presents shall come or may concern send Greeting Know ye that at the town of Lyons in the county of Wayne on the twenty eighth day of March in the year one thousand eight hundred and twenty six before Graham H. Chapin Esquire Surrogate of our said county the last will and testament of Coll Roy deceased (a copy whereof is hereunto annexed) was proved and is now approved and allowed of by us; and, the said, deceased, having whilst he lived and at the time of his death goods chattels or credit within the State, by means whereof the proving and registering the said will and the granting administration of all and singular the said goods chattels and credits and also the auditing allowing and final discharging the accounts thereof, doth belong unto us, the administration of all and singular the goods chattels and credits of the said deceased and any way concerning his will is granted unto William Paton, Henry Tower and James Roy Executors in the said will named hereby requiring you will and faithfully to administer the same and to make and exhibit a true and perfect inventory of all and singular the goods chattels and credits and also to render a just and true account thereof when thereunto required. In witness whereof we have ??? the seal of office of our said Surrogate to be hereunto affixed. Witness, Graham H. Chapin Esquire Surrogate of the said county at the town of Lyons aforesaid the twenty eighth day of March in the year of our Lord one thousand eight hundred and twenty six.

In the name of God Amen I Coll Roy of the town of Lyons and county of Wayne in the State of New York - being weak in body but of sound and perfect mind and memory considering the uncertainty of this mortal life and being at this time in my sound mind, blessed by Almighty God for the same do make and publish this my last will and testament in mannor and form following (that is to say) First I give and bequeath unto my wife Elizabeth Roy the use of all my farm that I now live on during her natural life together with the covenants that I have engaged to perform in a bond wrote by John Collins Esq in favour of my wife this bond to be fulfilled out of my property by my Executors - I do also give and bequeath to my daughter Jennet who is now the wife of Isaac Mills fifty dollars in cash and two feather beads compleated with beading and one third part of all my personal property my money due to my estate excepted - I do also give and bequeath to my grand son Roy Mills, legitimate son of Isaac Mills and son of the body of my daughter, one hundred dollars with lawfull interest from one year after my death to be paid to him when he becomes of age, day twenty one years of age by my executors - I do also give and bequeath to my son James Roy my large copper Kittle and one third part of all my personal property and one half of all my real estate and all the land that is patented to my son Charles Roy for his services performed in the late war with Great Britan, this is to be perfectly distinct and over and above the half of my Real Estate - I do also give and bequeath to my son Andrew Roy my large Bible and large iron Kittle and one third part of my personal Estate and one half of my real estate, except my five hundred dollars I bequeath as follows - The five hundred dollars I give and bequeath to Coll Roy my grand son and son of my son Andrew Roy the above five hundred dollars to be secured to my grand son Coll Roy untill he be twenty one years of age, to be taken out of the half of my Real Estate bequeathed to my son Andrew, and the interest or rent or income of that five hundred dollars to be paid to my son Andrew untill my grand son Coll Roy is twenty one years of age by my Executors - I also give and bequeath to my son William Roy if he ever should return two hundred dollars to be paid out of the property that I have bequeathed to my son James Roy and my son Andrew Roy, one of them will pay one hundred dollars to my son William if he should ever return to this country alive, out of the property that I have bequeathed to them. I also give and bequeath to my three grand sons, the sons of John Roy deceased, who was my son. The names of my grand sons are as follows - William Roy and Aaron Roy and Israel Roy - I bequeath to each of them two hundred dollars to each and every one of them to be secured out of my real estate and paid to them as they become of age, say twenty one years of age - I hereby appoint William Paton and Henry Towar both of the town of Lyons and county of Wayne and State of New York and James Roy of the town of Galen county & state of aforesaid as Executors of this my last will and testament hereby revoking all former wills by me and In Witness whereof I have hereunto set my hand and seal this 28th May one thousand eight hundred and twenty four

Wayne County - Be it remembered, that on the twenty eighth day of March in the year of our Lord one thousand eight hundred and twenty six personally appeared before me Graham H. Chapin Esquire Surrogate of the County of Wayne, Charles Towar and Mary P. Towar who have been duly sworn did depose and say that they deponents saw Coll Roy late of the county of Wayne deceased sign and seal the written instrument then shown unto them of which the aforegoing is a true copy purporting to be the last will and testament of the said Coll Roy deceased, bearing date the twenty eighth day of May in the year of our Lord one thousand eight hundred and twenty four. That at the time thereof the said Coll Roy was of a sound disposing mind and memory, to the best of the knowledge and belief of them the said deponents and that they the said deponents subscribed their names as witnesses to the said will in the presence of the testator
