John Henderson will, 4 April 1766, Augusta County, Virginia, will book 3:461.
In the name of God Amen The fourth day of April 1766 I John Henderson of the County
ofAugusta and the Colony of Virginia farmer Being very sick& weak in body but of a perfect
mind & memory thanks be unto God therefore calling unto mind the mortality of my body and
knowing that it is appointed for all men once to die do make and ordain this my last will and
testament that is to say principally First of all I give and recomend (recommend) my soul into the
hands of God that gave it and my body I commit to the earth to be buried at the discretion of my
executors nothing doubting but that at the general resurrection I shall receive it again by the
almighty power of God and as touching such worldly estate it hath pleased God to bless me in
this life I give and dispose of the same in the following manner and form Imprimis I give and
bequeath to my dearly beloved wife the third of my real and personal property and the remainder
of my movable estate I leave to my executors discretion in order to discharge my lawful and just
debts and my real estate I give to my son William by him to be freely posessed & enjoyed save
my wife's share before mentioned which I forever give to her discretion and disposing & likewise
William shall pay to each of his sisters fifteen pounds out of his share and if either of them by
God's providence should be removed (by death) the other shall enjoy it and I do hereby disallow
revoke and disannul all and every other testament wills legalities and bequests on executors by
me in any way before named I bequeath ratifing & confirming this and no other to be my last will
and testament In witness whereof I have hereunto set my hand and seal the day and year above
written

At a court continued & held for Augusta County August 20 th 1766 This last will and testament
of John Henderson deceased was proved by the oaths of the witnesses thereto I ordered to be
recorded who also made oath that they heard the testator acknowledge a memmorandum
appointing James Henderson & John Finley his executors who made oath according to law
Certificate is granted to them for obtaining a probate thereof in due form they having with
security entered into and acknowleged their bond according to law

Know all men by these present that we James Henderson John Finley Adam Dean & William Finley are held and firmly bound unto John Boyer Abraham Smith George Shellern & Beny Hawkins Justices of the commission of the peace for Augusta County for and in behalf of the justices of the said county in the sum of One thousand pounds to be paid to the said justices and their successors to which payment well and truly to be made we bind ourselves each of us and every heirs executors and administrators jointly and severally formily by these present sealed without seal dated this 20th day of August 1766.
The condition of this obligation is such that if the above bound James Henderson & John Finly
executors do make or cause to be made a true & perfect inventory of all Securities the goods
chattels declared of the deceased which have or shall come to the hand possession or knowledge
of them James Henderson & John Finly or into the hands or posession of any other person or
persons for them and the same so made to exhibit unto the County Court of Augusta at such time
as they shall be thereunto required by the court and the same goods chattels & credits and all
other the goods chattels and credits of the deceased at any time after shall come to the hands
possession of any other person or persons for them to well & truly administer according to law
and further to make a just and true account of their actings & doings therein when required by the
said court and also shall well & truly pay & deliver all securities contained and specified in the
said testament as for the said goods chattels and credits will extend and the law shall charge them
this obligation to be void and of non effect or else to remain in full force and virtue
